VELOCITY ENTERPRISES LIMITED TRADING AS BUBBLE RENTALS
AUCKLAND, NEW ZEALAND

These Terms & Conditions govern your rental agreement with us. Please read them carefully before signing the Rental Agreement. By renting a vehicle from VELOCITY ENTERPRISES LIMITED TRADING AS BUBBLE RENTALS, you acknowledge and agree to these terms.

AGREEMENT TO TERMS AND CONDITIONS

This Rental Agreement ("Agreement") is between BUBBLE RENTALS ("Company", "we", "us", "our") and the individual or entity renting the vehicle ("Hirer", "you", "your").

You agree to these Terms & Conditions.
You agree to comply with New Zealand road laws and regulations.
Additional terms in your rental contract also apply.

We reserve the right to amend these Terms at any time. The latest version will always be available on our website or upon request.

DRIVER LICENCE

All drivers must hold a current and valid NZ or International full drivers licence. If the licence is not in English, an official translation or International Driving Permit is required.

DEFINITIONS

Hirer: Person or business renting the vehicle.
Company: Bubble Rentals.
Vehicle: The rental car, its parts and documentation.
Rental Period: Agreed time for hire.
Insurance Cover: Coverage level selected.

DRIVER DEDUCTIBLES/EXCESSES

Drivers aged over 25 years with licence less than 01 year: $1500 to $3500 excess depends on the insurance policy you choose.
Drivers aged 21-25 years: $1500 to $3500 excess depends on the insurance policy you choose.
Drivers aged under 21 years: Additional $10 per day. $1500 to $3500 excess depends on the insurance policy you choose.
Drivers aged under 25 years: $1500 to $3500 excess, even if Driver/Hirer selected Premium Insurance.
Drivers aged over 25 years with licence more than 01 year: $0 to $3500 excess depends on the insurance policy you choose.
Drivers over 75 may need a medical certificate.
Driver licence and credit card required at the time of pickup.

DRIVER/HIRER REQUIREMENTS

Driver/Hirer must present their valid driver's licence at the time of pickup.
Driver/Hirer must present their active Credit/Debit card at the time of pickup.

AUTHORISED PERSON

Authorisation person is the person who has given his/her personal and drivers licence details to get the rental vehicle from Bubble Rentals.
Only authorisation person is allowed to pickup, drop off and drive the rental vehicle.
Failure to do so will result in a $1000 fine.
Bubble Rentals has the full right to cancel your rental agreement, if we believe that you are not driving the vehicle and you are not safe driver.

DRIVERS RESPONSIBILITY

The Driver/Hirer must carry the Drivers License and Rental agreement in the vehicle throughout the rental period.
As per New Zealand roads requirements you must drive the vehicle on left side (KEEP LEFT).
If you are not from New Zealand, the Driver/Hirer must read the "DRIVING IN NEW ZEALAND" guidelines.
You will find "DRIVING IN NEW ZEALAND" file on top header of the website and its available in many languages.
Do not drive the vehicle on Bus lane.
Do not park the vehicle at Mobility parking.
Please pay the parking charges if you park the vehicle at pay parking zone.
T2 Lanes: You are allow to drive the vehicle on T2 lane if 2 or more than 2 persons in vehicle.
T3 Lanes: you are allow to drive the vehicle on T3 lane if 3 or more than 3 persons in vehicle.
Please obey all road signs, NZ traffic rules and follow the variable speed limits on NZ roads.
Drive to the conditions.

CANCELLATION POLICY

48 Hours before pickup time: Full refund.
24 Hours before pickup time: 50% refund.
Same-day or no-show: No refund.
If authorised Driver/Hirer does not show up on the day of their booking. Bubble Rentals will charge the full amount for the rental period you booked.
Bubble Rentals may cancel the agreement at anytime if we believe you or your driving poses a genuine risk of harm to others or property. And If the New Zealand police, NZTA (New Zealand Transport Agency) and any other authorities personnel cancel your driving privileges in New Zealand because of any reason.The Driver/Hirer is responsible for outstanding debts and all costs incurred in recovering and returning the rental vehicle to our office in Auckland and Bubble Rentals will not refund for the remaining rental days.

OFF HOURS FEES

Opening hours: 6am - 6pm.
Pickup and drop off before 6am and after 6pm will establish $50 off hours fees.
Driver/Hirer selected a 6pm pickup time, Bubble Rentals will allow 15 minutes grace period.
If Driver/Hirer arrives after 15 minutes grace period, $50 after hours charges will apply.
However, if a Driver/Hirer is arriving by flight and is delayed due to the flight, $50 after hours charges will not apply.

EXTENSIONS

Hirers needs to obtain the authorisation from Bubble Rentals to extend the rental period while on hire.
Extension will be made on fleet availability.
12 Hours Prior Notice is required for extensions.
The Hirer will be charge the daily rate including insurance plus an additional NZ$250 for each day, failure to get the extension authorisation from Bubble Rentals.
Driver/Hirer must make the full payment for extension period.
Bubble Rentals will send you the extension rental agreement by email.

EARLY AND LATE RETURNS

No refund available on early returns and unused period of hire.
Late returns grace period is 15 minutes.
Late returns are charged at daily rate including insurance

NO-REFUND ON EARLY TERMINATION

No refund will be provided if:
Vehicle is impounded.
Agreement is terminated due to breach.
Vehicle is damaged or misused.
All prepaid amounts are forfeited in such cases.

PRIVACY POLICY

We collect, use and protect your personal data for services, legal compliance, and recovery of fines/debts. Online payments use secure Stripe 3D security systems.

PAYMENT & SECURITY DEPOSIT

All prices are in NZD. "Bubble Rentals" appears on statements.

Full payment at booking or pickup.
Accepts cards (Visa, MasterCard, Union Pay), and cash.
Afterpay and Klarna available at pay online.

SECURITY BOND

A refundable Pre-authorized hold is placed based on insurance selected:

Basic Cover: $3500 bond, $3500 excess
Standard Cover: $1500 bond, $1500 excess
Premium Cover: $150 bond, $0 excess

PRE-AUTHORISATION BOND

In NZ a Pre-authorisation bond is a temporary hold placed on your credit/debit card, to check customer have sufficient funds for a security deposit. The funds are not deducted immediately but are temporarily frozen, reducing your available credit limit until the hold is released.

HOW IT WORKS

VERIFICATION: When you pick up a rental car, we pre-authorises a certain amount on your credit/debit card.
PURPOSE: This is a security measures to ensure funds are available to cover potential costs like damages, cleaning fees, tolls, infringement offences or unpaid services.

WHAT HAPPENS WHEN YOU RETURN THE RENTAL VEHICLE

No CHARGES: If there are no issues, the pre-authorisation amount will be released, and you will only be charged for the final agreed-upon cost.
CHARGES ARE DEDUCTED: If there are damages or other charges like fines or unpaid tolls, the cost is deducted from the pre-authorisation bond.
RELEASE TIME: The time it takes for the pre-authorisation amount to be released varies depending on the bank but can take several days to a couple of weeks. The Bubble Rentals will release your bond after two weeks after you drop off the rental vehicle, because we usually receive any offences from the City Council (Auckland Transport) such as Bus Lane, T2/T3 lane offences and parking offences within that two week period. Bubble Rentals will make sure that no such offences have been received under your use of Rental Vehicle before releasing the bond.

INSURANCE EXCLUSIONS

Insurance Void If Anyone drives the rental vehicle,

Who is not authorised driver by Bubble Rentals.
Who does not hold a valid full drivers license, even if the driver named on the Bubble Rentals agreement.
Who has restricted drivers license and is not authorised by the Bubble Rentals Personnel.
Effecting any damage or loss by conducting any reckless or intentional act, including serious traffic violation.
On unsealed roads, beach, private road, riverbed, in any race, rally, speed test or any other type of contest.
In excess of speed limits or in a manner that establishes dangerous and careless driving.
While using mobile or any other hand carried electronic device.
To carry more passengers than the vehicle is legally certified for.
To carry more weight than the vehicle is certified for.
For hire purposes (rideshare partner) like uber or for any kind of reward.
Under influence of any drug, alcohol or intoxicating substance.
To transport any animal except disability assist dog under the dog control act 1996.
Using wrong fuel including putting diesel fuel into a petrol vehicle or vice versa. losing keys, or driving outside NZ.
Fail to provide the Police reports within 24 hours of an accident. A $1000 fine will be charged even you have Premium Insurance.

UNAUTHORISED USE AND GEOGRAPHIC RESTRICTIONS

The vehicle must not be:

Taken outside New Zealand.
Used for Rideshare, couriers, delivery or commercial hire.
Anwhere that is not officially designated as a road.
Any beach including Ninety Mile Beach, unsealed roads, private road, riverbed, off-road and non-commercial ski field road.
Tasman Valley Road beyond the picnic area, parking lot near Aoraki/Mount Cook.
Deer Park Heights (432 Peninsula road, Queenstown), Skippers canyon road near Queenstown.
The inland road between Tapu and Coroglen in the Coromandel.
Glenorchy Paradise Road beyond the Diamond Lake DOC campground.
Used for race,stunts, speed test, a rally, any other type of contest or illegal activity.
Any unauthorised use results in:
Immediate termination.
Insurance being void.
Full financial liability.
Possible involvement of authorities.

BASIC INSURANCE EXCESS/BOND NZ$3500

If the Driver/Hirer has selected the Basic Insurance option and gets involved in an accident where the Driver/Hirer is at fault.
If the repair cost is greater than the Excess/Bond amount which is NZ$3500 for Basic Insurance Excess/Bond.
Bubble Rentals will charge the Driver/Hirer full Excess/Bond amount which is NZ$3500 for Basic Insurance Excess/Bond.
However, if the repair cost is lower than the Excess/Bond amount which is NZ$3500 for Basic Insurance Excess/Bond.
Then Bubble rentals will refund your Excess/Bond amount minus towing charges to transport the vehicle to our Licensed Vehicle Repairer in Auckland and an administration fees of NZ$500.
If the third party is responsible for the accident, any relevant personnel authorities or our insurance broker confirms the third party is responsible.
Then Bubble Rentals will refund the Excess/Bond amount minus an administration fees of NZ$500.

STANDARD INSURANCE EXCESS/BOND NZ$1500

If the Driver/Hirer has selected the Standard Insurance option and gets involved in an accident where the Driver/Hirer is at fault.
If the repair cost is greater than the Excess/Bond amount which is NZ$1500 for Standard Insurance Excess/Bond.
Bubble Rentals will charge the Driver/Hirer full Excess/Bond amount which is NZ$1500 for Basic Insurance Excess/Bond.
However, if the repair cost is lower than the Excess/Bond amount which is NZ$1500 for Basic Insurance Excess/Bond.
Then Bubble Rentals will refund your Excess/Bond amount minus towing charges to transport the vehicle to our Vehicle Repairer in Auckland if it's applicable and an administration fees of NZ$500.
If the third party is responsible for the accident, any relevant personnel authorities or our insurance broker confirms the third party is responsible.
Then Bubble Rentals will refund the Excess/Bond amount minus an administration fees of NZ$500.

PREMIUM INSURANCE EXCESS/BOND

Premium Insurance Benefits: Windscreen Covers, Third Part Liability, 24/7 Roadside Assistance, Fully Insured Vehicles and Unlimited Kms.
Tyres and Rims are excluded from all covers, including Premium Insurance.
If the Driver/Hirer has selected the Premium Insurance option and gets involved in an accident where the Driver/Hirer is at fault.
Then Bubble Rentals will only charges an administration fee of NZ$250.
If the third party is responsible for the accident, any relevant personnel authorities or our insurance broker confirms the third party is responsible.
Then Bubble Rentals will only charges an administration fee of NZ$250.

IN THE EVENT OF ACCIDENT

If it's safe to do so, please take the pictures of damaged part of rental vehicle and others vehicles involves in accident along with the vehicles number plates.
If it's safe to do so, please park the vehicle on the side of the road with hazards light on.
If you are able to do so, please call 111 for Police, Ambulance and fire services.
Take the details of all other vehicles involved in accident.
Other Vehicle Registration Number, Color of the Vehicle, Driver's name, Front and back pictures of their Driver's License, Address and Mobile Number.
Do not arrange recovery or repair the rental vehicle. Please notify us promptly and cooperate to minimise the loss.
Bubble Rentals will charge you for transporting the vehicle to our Licensed Vehicle Repairer in Auckland, and these charges will be based on the insurance policy you selected.
Bubble Rentals may provide a replacement vehicle for the remaining period or terminate the remaining rental period at our discretion.
Bubble Rentals will not refund for the remaining rental period.

FUEL POLICY

Full tank provided.
Return with full tank or $50 + fuel cost applies.

FINES

All company and safety stickers (includin logo, fuel type and keep Left stickers) must remain on the vehicles at all times. Removal of any sticker will result in a $50 penalty plus a replacement cost of $30 per sticker.
Any interior damage caused by negligence (Cigarette burns, torn seats, stains or misuse) is not covered by insurance. The Driver/Hirer will be fully liable for the repair or replacement cost.
Vehicles must be returned in a reasonably clean condition. A cleaning fee of $250 will apply if the vehicle is returned excessively dirty (including interior rubbish, food spills, stains or mud).
Driver/Hirer is liable for Speeding tickets, private parking tickets, bus lane fines, toll road and anyother NZTA or Council infringement offences. Administration fees of $50 will apply per ticket.

VAPING / PET / CLEANING CHARGES

Smoking/vaping: $250
Animals in vehicle: $250
Excessive dirt: $250

ROAD SIDE ASSISTANCE

Premium Insurance Cover includes 24/7 assistance. It includes call out fees and vehicle towing covers up to $200 and any cost incurred above $200 will be Drivers/Hirers responsbility for mechanical issues. Non-Mechanical issues call out fees $250, any extra charges related to Non-Mechanical issues and vehicle towing cost for Non-Mechanical issues is fully Drivers/Hirers responsibility.

Basic and Standard insurance cover incurs $250 call-out fees for Non-Mechanical and Mechanical issues, any extra charges related to Non-Mechanical issues and vehicle towing cost for Non-Mechanical and Mechanical issues is fully Drivers/Hirers responsibility.

Non-Mechanical Issues:

Flat battery, lockout, lost keys, flat tyres, wrong fuel, out of fuel, vehicle towing and any other non-mechanical issues decided by road side assistance provider.
Driver negligence-related issues.
The driver/hirer is responsible for damage to Tyres and Rims even you get the Premium Insurance.

DAMAGED OR LOST RENTAL VEHICLE KEY

If the Drivers/Hirers damages or loses the rental vehicle key, even if they have Premium Cover including 24/7 roadside assistance, Bubble Rentals will still charge the Drivers/Hirers $500 for the replacement key.

BREAKDOWN PROTOCOL 0800 694 737

Follow thes tips to stay safe until help arrives. (Provided By Roadside Assistance Provider)

Slow down and pull over to a safe location away from traffic, such as the shoulder of the road.
Turn on your hazard lights to alert other drivers.
Do Not attempt any repairs yourself, wait for professional help.
Park on a flat, stable surface away from bend or blind spots in the road.
Keep your wheels turned away from traffic and engage the parking brake.
Stay with your vehicle, if it is safe do so, until help arrives.
Use reflective triangles or cones to alert other drivers.
If you exit your vehicle, wear a reflective vest if you have one, especially at night or in conditions of low visibility.
If you are on a busy highway or in unsafe conditions, remain inside your vehicle with your seatbelt fastened.
Only get out if it's safe and always on the side of the road that's away from traffic.
Help is just a Phone Call away 0800694737. You need to tell them this vehicle is from Bubble Rentals.
You will need to tell the Roadside Rescue team some details, including your Name, Phone Number, Vehicle Registration Number and Location.
They will be able to send you a link to track the progress of your vehicle.
Try to conserve your phone battery as the team may need to send you updates.
Contact Bubble Rentals immediately as well.
Bubble Rentals is not responsible for any costs due to breakdown. For Example: Accommodation costs, other rental vehicle and any other costs incurs due to breakdown.
Refund will be provided for unuse period of hire due to breakdown, if we do not provide you another vehicle.
Unapproved repairs are not reimbursed.

BREAKDOWN DUE TO NEGLIGENCE

If a breakdown occurs due to negligence, misuse or failure to follow warnings, the Driver/Hirer is responsible for all related costs including:

Towing.
Mechanical repairs.
Replacement vehicle.
Accomodation and travels costs.
Loss of revenue.
Examples Include:
Ignoring warning lights.
Overheating the engine.
Using incorrect fuel.
Driving while unsafe.

TOW, STORAGE AND REPAIR AUTHORITY

The Drive/Hirer grants full authority to Bubble Rentals to:

Arrange towing.
Select repairs.
Store the vehicle.
Approve repairs.
Recover costs from the bond.
No seperate approval is required from the Driver/Hirer.

INGRINGEMENT OFEENCES

Following Infringement Offences committed during the hire:

Speeding tickets, private parking tickets, bus lane fines, toll road and anyother NZTA or Council infringement offences is Hirers/Drivers responsibility.
Any offences detected by the vehicle surveillance equipment for not keeping a traffic signal direction.
An offence against part 6 or the Land Transport (Road User) Rule 2004.
An offence under section 20(1) of the Freedom Camping Act 2011.
An administration fees is $50 per infringement offences to cover the cost of transferring the offences.

PHOTOGRAPHIC AND VEHICLE CONDITION EVIDENCE

Bubble Rentals staff may take timestamped photos and/or videos at pickup and return.
These images will be treated as final and conclusive evidence of the vehicle's condition for:
Damage claims.
insurance claims.
Dispute resolution.
Legal proceedings.

SECURITY BOND AND AUTHORITY TO DEDUCT

The Drive/Hirer authorises Bubble Rentals to place a Pre-authorisation or charge a security bond to the credit or debit card provided, or to receive the bond by bank transfer, as security for any amounts payable under this Agreement. Bubble Rentals is authorised, without further notice to the Driver/Hirer, to deduct from the bond and/or the nominated card, any amount owed or incurred during or after the rental period, including but not limited to:

Insurance excess and repair costs for any damage to the vehicle.
Towing, recovery and storage fees.
Cleaning, detailing, smoke or biohazard charges.
Fuel, tolls and refueling costs.
Parking fines, speeding tickets, infringement penalties and related administration fees.
Loss of revenue resulting from the vehicle being unavailable due to damage or misuse.
Replacement or reprogramming of lost or damaged keys.
Roadside assistance or call-out charges.
Any unpaid rental charges, extensions or additional services.
Any other reasonable costs incurred as a result of the Driver's/Hirer's breach of this agreement.

Where valid insurance has been selected and no breach of these Terms & Conditions has occurred, the Driver's/Hirer's maximum liability will be limited to the stated excess amount.

However, if any breach of this agreement occurs including but not limited to unauthorised driver use, intoxicated driving, reckless behaviour, illegal activity, unapproved off-road use, or misrepresentation. The insurance shall be deemed void and the Driver/Hirer shall be fully liable for all losses, damages and associated costs without limitation.

Any unused portion of the bond will be released or refunded following completion of all checks, confirmation of no outstanding infrinfements, damages or charges, and in accordance with the bank's processing timeframes.

GOVERNING LAW

These Terms and conditions are governed by New Zealand law. All disputes are governed by New Zealand law and must be heard exclusively in the courts of Auckland, New Zealand.

ACKNOWLEDGMENT & ACCEPTANCE

By signing the Bubble Rentals Agreement, the Hirer/Driver acknowledges and agrees to all above terms and conditions.
